EXILE INC BASE COURSE WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK


I understand that BASE jumping is an extremely dangerous, largely self-regulated activity. While some countries, locations, clubs, access groups, object owners, or local organizations may impose site-specific rules, access requirements, recommendations, or informal standards, there is no universal official BASE jumping license, certification, governing body, or guaranteed standard of safety. PARTICIPATION CAN RESULT IN SERIOUS INJURY, PARALYSIS, TRAUMATIC BRAIN INJURY, DROWNING, PROPERTY DAMAGE, OR DEATH.

This waiver applies to all Exile Inc courses and related activities, including first jump courses, advanced BASE courses, ground training, packing instruction, gear checks, object assessment, weather assessment, hiking, climbing, transportation, landing-area activity, lodging connected to a course, mentorship, communications, and all related activities in Montana, Idaho, Utah, Brazil, Italy, or any other location where Exile Inc operates.

BY SIGNING THIS DOCUMENT, YOU MAY BE WAIVING YOUR LEGAL RIGHT TO A JURY TRIAL TO HOLD THE PROVIDER LEGALLY RESPONSIBLE FOR ANY INJURIES OR DAMAGES RESULTING FROM RISKS INHERENT IN THE SPORT OR RECREATIONAL OPPORTUNITY OR FOR ANY INJURIES OR DAMAGES YOU MAY SUFFER DUE TO THE PROVIDER’S ORDINARY NEGLIGENCE THAT ARE THE RESULT OF THE PROVIDER’S FAILURE TO EXERCISE REASONABLE CARE.

I understand and accept all risks, including but not limited to parachute malfunction, packing error, gear failure, off-heading openings, line twists, line overs, object strike, cliff strike, bridge strike, unstable exit, low deployment, poor body position, poor canopy control, poor landing, terrain impact, water impact, wind, turbulence, rotor, weather changes, rescue delay, limited medical access, hiking or climbing hazards, transportation accidents, mistakes by me, mistakes by others, and mistakes or ordinary negligence by Exile Inc or its owners, officers, directors, instructors, coaches, employees, contractors, agents, volunteers, affiliates, landowners, lodging hosts, transportation providers, successors, assigns, or representatives.

To the fullest extent allowed by law, I voluntarily assume all risks, known and unknown, and release and forever discharge Exile Inc, its owners, officers, directors, instructors, coaches, employees, contractors, agents, volunteers, affiliates, landowners, lodging hosts, transportation providers, successors, assigns, and related parties from all claims, lawsuits, demands, damages, attorney fees, liability, injury, death, property damage, emotional distress, or economic loss arising from or related to my participation, including claims based on ordinary negligence.

I understand that instruction, gear checks, packing help, weather calls, object assessments, landing briefings, recommendations, and mentorship are educational only and do not guarantee my safety. The final decision to participate, continue, use equipment, or jump is always mine.

I am responsible for my own fitness, judgment, equipment, packing, gear configuration, and decisions. I certify that all information I provide about my experience, health, training, emergency contacts, and equipment is true and complete. I agree not to participate while impaired by alcohol, drugs, medication, fatigue, injury, illness, or any condition that affects judgment or performance.

I agree to defend, indemnify, and hold harmless Exile Inc and the released parties from any claim, lawsuit, demand, damage, cost, attorney fee, or liability arising from my participation, conduct, equipment, decisions, negligence, recklessness, intentional acts, or any claim brought by me, my estate, my family, my heirs, or anyone acting on my behalf.

If I am injured or become ill, I authorize Exile Inc to obtain emergency assistance, rescue, evacuation, transportation, and medical treatment. I am responsible for all medical, rescue, evacuation, transportation, and related costs.

I allow Exile Inc to use photos, videos, audio, and recordings of me, my training, and my jumps for education, marketing, social media, advertising, safety review, and business purposes without compensation.

This Agreement is governed by Montana law to the fullest extent permitted and is intended to be enforceable to the maximum extent allowed under Montana, Idaho, Utah, Brazil, Italy, and any other applicable law. Any dispute shall be brought in Montana unless a court requires otherwise.

If any part of this Agreement is unenforceable, the rest remains in effect. This Agreement applies to my current participation and all future Exile Inc activities unless replaced by a later written agreement.

I CERTIFY THAT I HAVE READ THIS AGREEMENT, THAT I FULLY UNDERSTAND ITS CONTENT, AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND THAT I AM SIGNING IT OF MY OWN FREE WILL.
